This Privacy Policy explains how we collect, use, and disclose personal information when you use our Site and services. By using the Site, you agree to this Policy and our Terms of Use. If you do not agree, please do not use the Site.
1. Personal Information We Collect
We collect information directly from you and automatically from your device:
- Identifiers and Contact Details: name, email, phone, mailing address, and any information you submit via our forms.
- Case Inquiry Information: the details you provide about legal matters or defense needs.
- Communications: messages, support requests, testimonials.
- Device and Usage Data: IP address, browser, device type, pages visited, links clicked, session information.
- Cookies and Similar Technologies: used for essential functionality, analytics, security, and advertising. See Section 5 (Cookies and Tracking).
- Approximate Location: derived from IP to support security and analytics.
- From Service Providers and Partners: analytics and advertising platforms (such as Google and Meta) and tools we use to operate the Site.
2. How We Use Personal Information
We use personal information to: (a) operate and improve the Site; (b) respond to inquiries; (c) provide and secure our services; (d) perform analytics and measure performance; (e) personalize content; and (f) comply with law and enforce terms. Where applicable law requires, we will obtain consent, for example for non-essential cookies or marketing.
3. How We Disclose Personal Information
We disclose personal information to:
- (i) Service providers that host, secure, analyze, or support the Site, such as hosting, analytics, email and SMS, and customer service providers;

We do not sell your personal information for money. We do use analytics and advertising partners, such as Google and Meta, to measure performance and improve our marketing. Some of this activity involves sharing certain online identifiers and usage data with those partners for advertising and measurement, which some state privacy laws define as a "sale" or "sharing" of personal information. You can opt out of this activity through your Cookie Settings, your browser or device controls, or by using a browser that sends the Global Privacy Control (GPC) signal, which we honor.
4. Mobile Messaging (SMS/MMS)
The following applies to any text message program you opt into with us:
- We will not share mobile information with third parties or affiliates for their marketing or promotional purposes. Sharing with subcontractors that support our services, such as customer service providers, is permitted.
- Text messaging originator opt-in data and consent will not be shared with any third parties, except for the aggregators and providers that deliver the text message service on our behalf.
- You can opt out of text messages at any time by replying STOP. Reply HELP for help. Message and data rates may apply.
5. Cookies and Tracking
We use first-party and third-party cookies and similar technologies for: Essential functions (to run the Site), Analytics (such as Google Analytics), Security and fraud prevention, and Advertising and measurement (such as Google and Meta pixels). Where required, we request consent for non-essential cookies. You can manage preferences via our Cookie Settings (if enabled) or your browser. We honor legally recognized global privacy signals such as GPC.
6. Your Privacy Choices and Rights
- Advertising preferences: manage via your Cookie Settings or your browser and device controls, or use a browser that sends the Global Privacy Control (GPC) signal, which we honor. You can also email contact@dwitom.com with your request.
- Cookies: adjust preferences through your Cookie Settings or your browser and device controls.
- Email and SMS marketing: follow the unsubscribe instructions in the message. For SMS, text STOP.
- Access, Deletion, and Correction (where available under applicable law): email contact@dwitom.com with your request. We may verify your identity and respond consistent with applicable law.
7. Security and Retention
We employ administrative, technical, and physical safeguards designed to protect personal information, consistent with applicable New York law, including the SHIELD Act. No method is 100 percent secure. We retain information for as long as reasonably necessary for the purposes described above, including to comply with legal obligations and resolve disputes.
8. Children's Privacy
We do not intentionally collect information from children under 13, and our Site is not directed to them. If you believe a child has provided us with personal information, contact us at contact@dwitom.com and we will take appropriate steps to delete it.
9. Changes to This Policy
We may update this Policy from time to time. Changes will be effective when posted with the updated Effective Date. Material changes may be communicated by a prominent notice.
