    How to Check If Your License Is Suspended in NY

    If you're not certain of your status, check before you drive. Driving on a license you didn't know was suspended is its own criminal charge, and “I didn't know” is rarely a defense.

    Check Your Status Through MyDMV

    The fastest way is a MyDMV account on the New York State DMV website, where you can view your driving record and see any active suspensions or revocations along with the reason. You can also order a copy of your full driving abstract. If the suspension came from a court, the paperwork you received at arraignment or sentencing will say so. If it came from the DMV, you should have received an order in the mail — which is why an outdated address on your record causes so many problems.

    Suspension vs. Revocation: They Are Not the Same

    This distinction decides everything about getting back on the road. A suspension ends — it runs for a defined period, and when that period is over and any fees are paid, your license comes back. A revocation does not end on its own. When the revocation period expires, your license does not return automatically. You must apply for a new license, the DMV reviews your driving record before deciding, and it can refuse. Most DWI convictions carry revocations, not suspensions. People plan for the wrong one constantly.

    Why a DWI Arrest Suspends Your License Before You Are Convicted

    The Suspension at Arraignment

    You don't have to be convicted to lose your license. At arraignment, in most DWI cases, the court suspends your license pending prosecution. That happens on your first appearance, often within a day or two of the arrest, months before the case is resolved.

    Hardship Privilege: The First 30 Days

    A hardship privilege is a narrow, temporary authorization to drive for essential purposes — work, school, medical treatment — while the case is pending. It's requested from the court, usually at arraignment, and it generally bridges the roughly 30-day gap before a conditional license becomes available. You have to establish extreme hardship with real documentation, and it isn't granted automatically. If you refused the chemical test, you are not eligible for a hardship privilege at all.

    What Is a Conditional License in NY?

    A conditional license is issued by the DMV to a qualified driver whose license was suspended or revoked for an alcohol- or drug-related violation. To get one, you enroll in the Impaired Driver Program — a seven-week DMV course previously called the Drinking Driver Program.

    What a Conditional License Lets You Drive To

    • To and from work, and during work hours if your job requires driving
    • To and from an accredited school, college, university, or state-approved vocational or technical program you're enrolled in
    • To and from your IDP class or any authorized IDP activity
    • To and from a DMV office for business about your conditional license or the IDP
    • To and from court-ordered probation activities
    • To and from medical appointments that are part of necessary treatment for you or a member of your household — carry a written statement from your medical practitioner
    • To and from your child's school or daycare, if that attendance is necessary for you to keep working or stay enrolled in school
    • One assigned three-consecutive-hour period per week, between 5 a.m. and 9 p.m., for personal business

    That weekly three-hour block is assigned and fixed. It doesn't move because your schedule did.

    Commercial driving

    A conditional license is never valid for operating a vehicle that requires a CDL.

    Driving to high school

    College and vocational school qualify; high school does not.

    Everything else

    Groceries, errands, picking up a friend, a weekend trip — unless it falls inside your assigned three-hour window, it isn't authorized.

    Enrolling in the Impaired Driver Program

    The DMV calls the IDP voluntary. In practice it's close to mandatory: enrollment is the prerequisite for a conditional license during your revocation, and completion is typically required before full reinstatement. Your Order of Suspension or Revocation names the motor vehicle office where you can enroll and apply.

    If your license was suspended at arraignment and your case is still pending, you may be able to obtain a conditional license roughly 30 days into the prosecution — before your case is resolved.     Post-Conviction & the 20-Day Stay

    After sentencing, the DMV typically takes about 20 days to issue a conditional license. That creates a gap — sentenced today, no driving privileges for roughly three weeks.     When You Cannot Get a Conditional License

    If You Refused the Chemical Test

    A conditional license is generally not available where the suspension or revocation stems from a chemical test refusal. Completing the IDP does not fix this — the rules specifically provide that a refusal revocation isn't set aside by finishing the program. If you refused, the DMV refusal hearing is the proceeding that matters, because there is no workaround waiting behind a loss.

    Prior Conviction or Refusal Within Five Years

    A prior alcohol-related conviction or refusal within the past five years generally disqualifies you — both from a pre-conviction conditional license while the case is pending and from a post-conviction one afterward. For repeat clients this usually means no legal driving for the full revocation period, which is a major reason to fight the underlying charge rather than resolve it quickly.

    If You Hold a CDL

    A conditional license never authorizes commercial driving. If driving the truck is the job, limited privileges in your personal vehicle don't preserve your income.

    How People Lose a Conditional License They Already Have

    A conditional license is easier to lose than to get.

    Any moving violation conviction

    Speeding, cell phone, seat belt — any moving violation conviction while you hold a conditional license results in revocation of the conditional license.

    Being dropped from the IDP

    Revokes it immediately. Re-entry requires the program director's consent and a $50 re-entry fee, and a conditional license can only be re-issued one time.

    Out of the program more than 90 days

    Means starting the entire seven-week course over and paying the course fees again.

    Driving outside the authorized purposes

    Puts the privilege at risk and can expose you to a new charge.

    Getting Your License Back After a DWI Revocation

    Applying for Reinstatement

    When the revocation period ends, you apply — the license does not come back on its own. Expect a $100 re-application fee, plus a $50 suspension termination fee in many cases, and proof of IDP completion where it was required.

    The DMV Reviews Your Record First

    Under 15 NYCRR Part 136, the DMV examines your driving history before approving a new license, using a 25-year lookback that counts both convictions and incidents — including chemical test refusals, which are not criminal convictions but still count. Two or more alcohol- or drug-related violations within 25 years establishes a history of alcohol or drug abuse under the regulations, and the DMV must receive proof you completed evaluation and any required treatment before it will relicense you.

    When the DMV Says No Permanently

    New York tightened these rules effective January 3, 2025. Four or more lifetime alcohol- or drug-related convictions or incidents now results in permanent license denial, as does three or more combined with a serious driving offense. Most information online still describes the older five-conviction threshold. Permanent denial can be revisited only where there are unusual, extenuating, and compelling circumstances — a narrow, discretionary standard. If you're facing it, that petition is not a form to fill out. It's an evidentiary submission.

    If Your Application Is Denied

    A denial isn't necessarily the end. Depending on the letter you receive, you may be able to reapply on a stated date or request reconsideration within a limited window after the denial. The deadlines are short and easy to miss.

    Driving While Suspended Is a Separate Crime

    If you drive while suspended or revoked, you can be charged with Aggravated Unlicensed Operation — a criminal charge in its own right, entirely separate from the DWI that caused the suspension.
